Terms of Service

Welcome to GiftSong. By downloading, installing, or using the GiftSong application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. About the Service

GiftSong is a mobile application that allows you to create personalized AI-generated songs using your own voice. You record a short voice sample, write a message, choose an occasion, and the App produces a unique song that you can listen to and share via a themed gift link.

The App does not require account creation. Your data is associated with an anonymous device identifier.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly provide the App to children under 13.

3. Voice Recording & AI-Generated Content

By recording and submitting a voice sample, you:

• Grant us permission to process your voice through our AI music generation service for the purpose of creating personalized songs.
• Understand that your voice recording is stored on our servers to maintain your voice profile (see our Privacy Policy for details).
• Acknowledge that AI-generated songs are produced by machine learning models and may not always meet your expectations in quality, accuracy, or tone.

We do not use your voice recordings or messages to train AI models. Your voice is used solely to generate songs you request.

4. Content Ownership

Your content: You retain ownership of the text messages you submit and the voice recording you provide.

Generated songs: The AI-generated songs are created using third-party AI technology. While you have the right to use, share, and enjoy the songs generated for you, please be aware:

• AI-generated outputs are not guaranteed to be unique. Similar inputs may produce similar results for different users.
• Copyright protection for AI-generated content varies by jurisdiction and is an evolving area of law. We make no guarantees regarding the copyright status of generated songs.
• You are responsible for how you use and share the songs you create.

Our license: By using the App, you grant GiftSong a non-exclusive, royalty-free license to use anonymized, aggregated usage data to improve the App. We will not use your specific songs or voice for marketing purposes without your explicit consent.

5. Sharing & Gift Links

When you share a song, a publicly accessible link is created. By sharing:

• You acknowledge that anyone with the link can access the song, its title, and its lyrics.
• You are responsible for the content of the messages you write. Do not include sensitive personal information, threats, harassment, or illegal content in your messages.
• Shared links cannot currently be revoked. Please share responsibly.

6. Subscriptions & Payments

GiftSong offers a free tier (limited number of songs) and paid subscription plans for unlimited access.

• Billing: All subscriptions are processed through the Apple App Store. We do not collect or store any payment information.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Cancellation: You can manage or cancel your subscription through your Apple ID settings at any time. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
• Price changes: Subscription prices may change. You will be notified of any price changes before your next renewal.

7. Acceptable Use

You agree not to:

• Use the App to create content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempt to reverse engineer, decompile, or extract the source code of the App.
• Use automated tools, bots, or scripts to interact with the App or circumvent usage limits.
• Interfere with or disrupt the App's infrastructure or other users' experience.
• Record and submit another person's voice without their knowledge and consent.
• Use generated songs to impersonate another person or for fraudulent purposes.

We reserve the right to suspend or terminate access for users who violate these Terms.

8. Third-Party Services

The App relies on third-party services for AI music generation (Mureka), analytics (Mixpanel), infrastructure (Cloudflare), and payment processing (Apple App Store). We are not responsible for outages, errors, or data practices of these third-party providers. Please review their respective privacy policies and terms of service.

9. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• That the App will be uninterrupted, error-free, or free of harmful components.
• That AI-generated songs will meet your specific expectations or requirements.
• That generated content will be free of intellectual property conflicts.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GiftSong and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or damages arising from reliance on AI-generated content.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless GiftSong, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. Upon termination, your right to use the App ceases immediately. Sections 4, 9, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved through binding arbitration administered under applicable arbitration rules, conducted on an individual basis. You waive any right to participate in a class action or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you disagree with any changes, please stop using the App.
